01/25/2007 ~ The Utility Board approved language changes to the utilities Enabling Act, and directed Keys Energy Services (KEYS) Staff to take the necessary steps to move the approved changes through the Florida Legislature, at their regular meeting on Wednesday, January 24th.

The State of Florida Legislature established the Utility Board through the Enabling Act in 1969 which sets forth the parameters under which the Utility Board governs KEYS. The legislature has previously amended the Enabling Act in order to improve operational efficiencies. The changes that were approved by the Board will continue to improve operating efficiencies and enable the Utility Board to operate with great continuity.

Changes to the Enabling Act include:

- Eliminating the requirement for the Board to go to the Key West City Commission for approval to issue bonds.

- Moving to elect five Board members, rather than four members and a chairperson, with the five members selecting their own chairperson during the Organizational Meeting following an election.

- Updating the process for filling a Utility Board vacancy to include that the vacancy be filled within 60 days rather than 30.

- Eliminating the three-year residency requirement for senior citizen/disabled American Veteran discount applicants.

- Improving and updating the purchasing, surplus, and property appraisal process.

In other business, the Board appointed Alan Toriello as the District Three (Shark Key to Sugarloaf Key) representative of the Advisory Committee. Toriello will replace outgoing District Three representative and current chairperson Sandra Walters who has termed out of her appointment.

The regular meeting of the Utility Board took place at 5:00 p.m., January 24th, in the Louis Carbonell Board Room of the William Arnold Service Building, 1001 James Street, Key West.
